Flourish Connect Outreach (Foundation CIO)

These Terms and Conditions set out the basis on which individuals may access the website, services, activities, and resources of Flourish Connect Outreach. They are written in line with the charity’s Foundation CIO governing document, charity law, and Charity Commission guidance.

By accessing or using the charity’s website, activities, or services, users agree to comply with these Terms and Conditions.

  1. Legal Status of the Charity (Foundation CIO)

Flourish Connect Outreach is a Charitable Incorporated Organisation (CIO) governed by a Foundation CIO constitution.

The charity exists solely to further its charitable objects for public benefit, as set out in its governing document. Nothing in these Terms and Conditions creates a contractual, employment, or agency relationship with the charity unless expressly stated.

  1. Trustee Responsibility and Governance

The Board of Trustees has overall responsibility for:

  • The governance and strategic direction of the charity

  • Ensuring activities are lawful and further the charity’s objects

  • Overseeing compliance with Charity Commission guidance

  • Approving policies, procedures, and terms governing the charity’s work

All activities and services operate under trustee oversight.

  1. Use of the Website and Materials

The charity’s website and digital platforms are provided for:

  • Public information

  • Communication about charitable activities

  • Access to resources and updates

Users agree to:

  • Use the website lawfully and respectfully

  • Not misuse or interfere with content or systems

  • Not use content for commercial purposes without permission

The charity may update or withdraw website content at any time.

  1. Participation in Activities and Services

Participation in events, programmes, training, outreach, or Academy activities:

  • Is voluntary

  • Does not create a contractual right to ongoing services

  • Is subject to availability and eligibility criteria where applicable

The charity reserves the right to refuse or withdraw participation where necessary to protect safety, wellbeing, or compliance with policies.

  1. Membership (Foundation CIO Aligned)

Where the charity has members, membership is:

  • Defined and managed in accordance with the Foundation CIO constitution

  • Separate from trustee status unless formally appointed

  • Subject to the rules, rights, and responsibilities set out in the governing document

Access to member-only areas or information does not confer legal authority or decision-making powers unless specified in the constitution.

  1. Volunteering and Team Involvement

Volunteers and team members:

  • Act in a voluntary capacity

  • Are not employees or agents of the charity

  • Must comply with the charity’s policies, including safeguarding and conduct

The charity may end volunteer involvement where necessary, in line with governance arrangements.

  1. Donations and Financial Support

All donations and support:

  • Are voluntary

  • Are used to further the charity’s charitable purposes

  • Are managed in line with charity law and good financial practice

Refunds or restrictions on donations are handled in accordance with charity law and the Fundraising Regulator’s guidance.

  1. Safeguarding and Acceptable Behaviour

All individuals engaging with the charity must:

  • Behave respectfully and responsibly

  • Comply with safeguarding expectations

  • Avoid behaviour that may cause harm or distress

The charity may take appropriate action, including restricting access, where behaviour breaches safeguarding or conduct standards..

  1. Intellectual Property

Unless stated otherwise:

  • Content on the charity’s website and materials remains the property of Flourish Connect Outreach

  • Content may not be reproduced or used for commercial purposes without permission

  1. Limitation of Liability

The charity takes reasonable steps to ensure information is accurate and activities are delivered safely. However:

  • Participation is at an individual’s own risk

  • The charity is not liable for loss or damage except where required by law

Nothing in these Terms limits liability for matters that cannot be excluded by law.
